1. Acceptance of Terms
Welcome to www.dilsebol.com (Dilsebol Customized Apparel Private
Limited, ""Dilsebol""). Dilsebol provides its Site and
related services (""Site"") to you subject to the following
User Agreement (""Agreement""), which may be updated from
time to time without notice to you. Your continued use of
the Dilsebol Site after any such changes constitutes your
acceptance of the new terms. If you have any questions about
the Agreement, you may contact us at

BY CONTINUING TO USE THE SITE, YOU ARE INDICATING YOUR
AGREEMENT TO BE BOUND BY THE TERMS OF THIS AGREEMENT AND ALL
REVISIONS THEREOF.
2. User Account, Password, and Security
You will have a password and account upon completing the
Site's registration process. You are responsible for
maintaining the confidentiality of the password and account,
and are fully responsible for all activities that occur
under your password or account. You agree to (a) immediately
notify Dilsebol of any unauthorized use of your password or
account or any other breach of security, and (b) ensure that
you exit from your account at the end of each session.
Dilsebol cannot and will not be liable for any loss or
damage arising from your failure to comply with this Section
2.
3. User Conduct
In using this Site, you agree to not:
a) upload, download, post, email, create, design or
otherwise transmit any materials including but not limited
to text, data, photos, graphics, or any of these elements in
combination as a design for products available on this Site
or otherwise (""Content"") that are unlawful, harmful,
threatening, abusive, vulgar, harassing, defamatory,
obscene, pornographic, indecent, inflammatory, libellous,
hateful, or racially, ethnically or otherwise objectionable;
b) impersonate any person or entity or falsely state or
otherwise misrepresent your affiliation with a person or
entity;
c) upload, download, post, email, create, design or
otherwise transmit any Content that may infringe any patent,
trademark, trade secret, copyright or other intellectual or
proprietary right of any party. By uploading or downloading
any Content, you represent and warrant that you have the
lawful right to reproduce and distribute such Content and
that the Content complies with all applicable laws;
d) upload, download, post, email, create, design or
otherwise transmit any Content that would constitute or
encourage a criminal offence, violate the rights of any
party, or that would otherwise create liability or violate
any local, state, national, or international law;
e) upload, download, post, email, create, design or
otherwise transmit any unsolicited or unauthorized
advertising, promotional materials, junk mail, spam, chain
letters, or any other form of solicitation;
f) upload, download, post, email, create, design or
otherwise transmit any material that contains software
viruses or any other computer code, files or programs
designed to interrupt, destroy or limit the functionality of
any computer software or hardware or telecommunications
equipment;
g) upload, download, post, email, create, design or
otherwise transmit false or misleading information;
h) disrupt or interfere with the security of, or otherwise
abuse, the Site, or any services, system resources,
accounts, servers, or networks connected to or accessible
through the Site or affiliated or linked Sites.
i) access, tamper with or use non-public areas of the Site;
j) disrupt or interfere with any other user's enjoyment of
the Site or affiliated or linked Sites;
k) frame or link to the Site except as permitted in writing
by Dilsebol;
You acknowledge that Dilsebol does not pre-screen submitted
Content, but that Dilsebol and its designees shall have the
right (but not the obligation) in their sole discretion to
reject or remove any Content that is available via the Site.
Upon placing your order, you acknowledge that Dilsebol may
review your order and the Content it contains, for adherence
to our guidelines and compliance with the terms and
conditions set forth in this User Agreement. Without
limiting the foregoing, Dilsebol and its designees shall
have the right to remove any Content and / or refuse to
process any design that violates the Agreement or is
otherwise objectionable to Dilsebol. In such cases where a
design is rejected and not processed, the paid amount will
be refunded to you after deducting 10% as Administration
charges. You agree that you must evaluate, and bear all
risks associated with, the use of any Content, including any
reliance on the accuracy, completeness, or usefulness of
such Content. In this regard, you acknowledge that you may
not rely on any Content, created by or submitted to,
Dilsebol. You acknowledge and agree that you are responsible
for the creation and compilation of your Content, and that
neither Dilsebol nor any other party involved with the
production of any product incorporating such Content assumes
that responsibility. Dilsebol's production of any product
depicting your Content does not indicate that Dilsebol
approves of the Content, that the Content obeys all
applicable laws, or that you are absolved of any liability
or harm arising from the use of the Content.
You acknowledge and agree that Dilsebol may preserve Content
and may also disclose Content if required to do so by law or
in the good faith belief that such preservation or
disclosure is reasonably necessary to: (i) comply with legal
process; (ii) enforce the Agreement; (iii) respond to claims
that any Content violates the rights of third-parties; or
(iv) protect the rights, property, or personal safety of
Dilsebol, its users and the public.
You understand that the technical processing and operation
of the Site, including your Content, may involve (i)
transmissions over various networks; and (ii) changes to
conform and adapt to technical requirements of connection
networks or devices.
In addition, you agree that you are solely responsible for
actions and communications undertaken or transmitted under
your account. Dilsebol takes no responsibility and assumes
no liability for any Content uploaded or otherwise
transmitted by or to you or by or to any third-party, or for
any mistakes, defamation, slander, libel, omissions,
falsehoods, infringement, obscenity, pornography or
profanity you or a third party may encounter. Dilsebol
reserves the right but not the obligation to remove any
materials it deems objectionable. You hereby agree to waive
any claims against Dilsebol and its affiliates, contractors,
agents and employees for losses, damages and injuries which
are based on or relate to communications or materials made
available to the Site or posted on the Site by persons other
than Dilsebol or its affiliates.
No royalty will be owed or paid on the sale of any items
containing an image which is in violation of any of the
provisions of this User Agreement, including but not limited
to no royalty on any images that contain objectionable
content or are posted in violation of the intellectual
property, privacy or celebrity rights of any person or
entity.
You acknowledge and agree that you will use this Site and
any products ordered on this Site at all times in accordance
with all applicable laws and will not take any action that
harms or violates the rights of any person or entity.
4. Privacy Policy
Your privacy is very important to Dilsebol.
But first, a note about uploading and posting information on
the Dilsebol Site: At the time you register for a user
account, you will choose and provide us with a user name
(which is your email address) and password. Only that part
of your username that is present till the @ sign will be
used in all displays in the site to identify you. When you
upload a design, post a comment or message on the Dilsebol
Site, your user name is visible to other users.
Additionally, if your comment or message contains personal
information and is posted by you in a page that is
accessible to the public, third parties may make note of the
information and you may receive unsolicited messages from
other parties as a result. Any content or information you
upload is not considered personally identifiable information
subject to this Privacy Policy. Always use care when you
post such information.
What information do we collect?
Information Provided by You:
You may provide us with certain personally identifiable
information when you:
Register for a user account;
order products or gift certificates;
request customer support or send us any other communication;
sign up for newsletters, email alerts, and special offers;
enter sweepstakes or contests;
sign up for, or redeem, special offers;
respond to surveys;
use our Email-to-a-Friend or Refer-A-Friend features;
Such information may include your name, email address and
shipping address. You may also provide us with information
about other people, such as their email addresses, if you
email a product to a friend or refer a friend to the
Dilsebol Site or our promotions. Credit Card number and / or
other payment processing related information will be
collected by our payment gateway partner. Dilsebol does not
collect or store payment related information like Credit
Card number, Bank Account number etc.
Information Collected by Web Beacons and Log Files:
Dilsebol collects certain non-personally identifiable
information through the use of web beacons and log files.
Such information may include your IP address, browser type,
site usage, and whether you opened emails you received from
us.
How do we secure your information?
When you place orders or access your account information, we
use commercially reasonable and generally-accepted
technological safeguards to secure any information we
collect about you. Your user account information is
password-protected for your privacy and security. You should
always take steps to protect the confidentiality of the
password you select.
How do we use information?
We use the personally identifiable information you provide
to:
provide the features and functionality of the Dilsebol Site;
fulfil your requests for our products and services;
pay royalties and referral fees or award reward points;
communicate with you about the status of your orders and
other inquiries about our products and services;
send you information about our products and services; and
provide notices about the results of sweepstakes, contest,
and other promotions.
We use your email address to communicate with you about your
account and to send you certain notification emails. You can
change the frequency of those emails in your account
settings.
If you email a product to a friend or refer a friend to the
Dilsebol Site or our promotions, we will use your friend's
email to send them the e-mail you requested. You and your
friend's e-mail addresses will only be used for this purpose
unless permission is otherwise granted.
We use non-personally identifiable information to monitor
the use and performance of the Dilsebol Site so that we can
learn more about how people use the Dilsebol Site and
improve our products and services.
Does Dilsebol disclose the information it collects to
outside parties?
Generally, Dilsebol does not share personal information
about you with other people or non-affiliated / non-partner
companies without your consent except that:
Dilsebol provides information to its agents and trusted
service providers and contractors for limited purposes, such
as: fulfilling customer orders and processing credit card
transactions; offering certain products and services;
communicating with customers; providing customer service;
managing information on our behalf; and enhancing the
Dilsebol Site features and functionality. In such cases, we
require that these parties agree to use the information
solely for the purpose for which we provided it to them and
in accordance with our privacy policy.
If you sign up for a promotion (e.g., a contest or
sweepstakes offer) or enrol in a service we offer in
partnership with a third party, we may provide information
(such as your name, email address, and account activity) to
such third parties.
Dilsebol may also release information (including your name,
addresses, telephone number, and account activity) when we,
in our sole discretion believe that such release is
necessary or appropriate to:
comply with law;
comply with subpoenas, warrants, court orders, government
investigations, or other legal process;
enforce or apply the terms of any of our user or license
agreements;
investigate or respond to allegations of fraud, intellectual
property infringement, or other unlawful activity
investigate fraud or similar claims; or
protect the rights, property or safety of Dilsebol, our
users, or others.
In the event that Dilsebol is acquired by, or merged with,
another company Dilsebol reserves the right to transfer all
information we have collected from our users in connection
with such acquisition or merger.
Dilsebol may disclose non-personally-identifiable
information to third parties in aggregate form to potential
business partners and investors.
Personal information at Dilsebol is kept confidential and is
disclosed only with the consent of the Dilsebol user or as
set forth in this Privacy Policy.
How can I change, delete, or update my information?
Most of your account information can be changed in the user
account section of the Dilsebol Site. If you have any
questions about what information is stored or would like to
obtain a copy of such information, please contact us at
admin@Dilsebol.com. After receiving proof of your
identity, we will provide the information to you, and you
may request that we delete or change any or all of the
information.
5. Proprietary Rights
You may not use or distribute any Content received through
the site without the authorization of the Content owner,
except for uses permitted by law.
You retain all ownership rights to your Content. However, by
submitting Content or uploading as a design for products to
Dilsebol, you grant Dilsebol a non-exclusive, worldwide,
transferable license to copy, crop, modify, reproduce,
publicly display, and distribute your Content and / or your
design.
You agree not to modify, rent, lease, loan, sell, distribute
or create derivative works based on the Site or the
Software, in whole or in part.
The intellectual property rights in or relating to the
content of any notes, messages, e-mails, postings, letters,
ideas, suggestions, concepts or other written materials
which you submit or communicate to Dilsebol (excluding the
Content) will automatically be deemed to be assigned,
granted and transferred by you to Dilsebol upon their
submission or communication to Dilsebol, and you agree that
the same will automatically become the property of Dilsebol
and that Dilsebol shall be entitled to use, exploit, copy,
publish, implement, transfer and in all other ways deal with
such materials and all of the intellectual property rights
therein in any way and for any purpose Dilsebol may elect,
forever.
6. Copyright and Trademark Policy
Dilsebol respects the intellectual property rights of
others. We ask our users to do the same. Dilsebol may
terminate the accounts of users who appear to infringe the
copyright or other intellectual property rights of others.
7. WARRANTY OF OWNERSHIP AND NON-INFRINGEMENT
YOU REPRESENT AND WARRANT THAT YOU ARE THE OWNER OF THE
CONTENT WHICH YOU SUBMIT AND THAT THE CONTENT DOES NOT
INFRINGE UPON THE PROPERTY RIGHTS, INTELLECTUAL PROPERTY
RIGHTS (COPYRIGHTS AND TRADEMARKS) OR OTHER RIGHTS OF
OTHERS. YOU ALSO REPRESENT THAT THERE ARE NO OUTSTANDING
DISPUTES IN CONNECTION WITH THE PROPERTY RIGHTS,
INTELLECTUAL PROPERTY RIGHTS OR OTHER RIGHTS IN THE CONTENT
OR ANY PARTS OF THE CONTENT.
8. No Resale
You agree not to reproduce, duplicate, copy, sell, resell or
exploit for any commercial purposes, any portion of the
Site, use of the Site or access to the Site without
Dilsebol’s express written consent.
9. Termination
You agree that Dilsebol, in its sole discretion, may
terminate your password, account (or any part thereof) or
use of the Site, and remove and discard any Content you may
have contributed to the Site, at any time for any reason or
no reason. Dilsebol may also in its sole discretion and at
any time discontinue providing the Site, or any part
thereof, with or without notice. You agree that any
termination of your access to the Site under any provision
of this Agreement may be effected without prior notice, and
acknowledge and agree that Dilsebol may immediately
deactivate or delete your account and all related
information and files in your account and/or bar any further
access to such files of the Site. Further, you agree that
Dilsebol shall not be liable to you or any third-party for
any termination of your access to the Site. Should you
object to any terms and conditions of the Agreement or
become dissatisfied with the Site in any way, your only
recourse is to immediately discontinue your use of the Site
and/or terminate your account.
10. Links
In the normal course of business, the Site may provide, or
third parties may provide, links to other Sites or
resources. Because Dilsebol has no control of such sites and
resources, you acknowledge and agree that Dilsebol is not
responsible for the availability of such sites or resources,
and does not endorse and is not responsible or liable for
any content, advertising, products or other materials on or
available from such sites or resources. You further
acknowledge and agree that Dilsebol shall not be responsible
or liable, directly or indirectly, for any damage or loss
caused or alleged to be caused by or in connection with use
of or reliance on any such content, goods or services
available on or through any such site or resource.
11. Public Reputation
You acknowledge and agree that you will not use any product
ordered from Dilsebol.com in a way that would be damaging to
Dilsebol's public reputation or that of its employees, board
members, shareholders, licensors, business partners or
solution partners. Additionally, you acknowledge that if you
choose to display any product ordered from Dilsebol in a
public setting, including on the Internet, in a way which
disparages Dilsebol, Dilsebol's board members, employees,
shareholders or partners, Dilsebol reserves the right to
demand immediate return of the product, to furthermore
pursue all recourses and remedies available under the law.
12. Pricing
Prices for products on Dilsebol.com are described on our
Site and are incorporated into this Agreement by reference.
All prices are in Indian Rupees (INR). Prices and products
may change at Dilsebol's discretion.
13. Age and Geographic Restrictions
You must be at least 18 years of age to use Dilsebol.com or
if you are lesser than 18 years of age, have parental
permission to open and maintain an account.
You must be authorised to effect payments for products
ordered through Dilsebol Site.
Dilsebol only accepts orders for Dilsebol products that are
shipped to locations within India.
14. Production
Based on the advice of Dilsebol production team, alterations
to certain aspects of your custom product order such as the
merchandise, size, colour, print size, print colour etc.,
may be required due to limitations caused by available
product, available production materials, production
equipment capabilities, as well as limitations caused by the
quality or type of your submitted design. In this instance
you agree that Dilsebol will send an approval request via
the email address which you submitted when placing your
order. If you do not agree with the requested change you
retain the right to reject the requested production change
by replying to it within 10 days of it being sent to you.
Dilsebol may re-request that you accept a production
alteration one additional time if an alternative method to
produce your merchandise is available. If you reject this
2nd request your order will be cancelled and you will be
fully refunded via your initial method of payment.
15. DISCLAIMER OF WARRANTIES
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SITE IS AT
YOUR SOLE RISK. THIS SITE AND THE INFORMATION, SERVICES,
PRODUCTS, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED ON
AN ""AS IS"" AND ""AS AVAILABLE"" BASIS.
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE
LAW, DILSEBOL AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL
WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO ANY WARRANTIES OF TITLE, OR IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE AND NON-INFRINGEMENT.
DILSEBOL DOES NOT MAKE ANY WARRANTY THAT (A) THE SITE OR ITS
CONTENT WILL MEET YOUR REQUIREMENTS, OR (B) THAT THE SITE OR
SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR
FREE, OR (C) THE QUALITY OF ANY PRODUCTS, SERVICES,
INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU
THROUGH THE SITE WILL MEET YOUR EXPECTATIONS, OR (D) THAT
DEFECTS, IF ANY, WILL BE CORRECTED. YOU AGREE THAT DILSEBOL
SHALL HAVE NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY YOU
IN CONNECTION WITH THE SITE OR ANY CONTENT CONTAINED THEREIN
INCLUDING BUT NOT LIMITED TO LOSS OF DATA FROM DELAYS,
NONDELIVERIES OF CONTENT OR EMAIL, ERRORS, SYSTEM DOWN TIME,
MISDELIVERIES OF CONTENT OR EMAIL, NETWORK OR SYSTEM
OUTAGES, FILE CORRUPTION, OR SERVICE INTERRUPTIONS CAUSED BY
THE NEGLIGENCE OF DILSEBOL, ITS AFFILIATES, ITS LICENSORS,
OR A USER'S OWN ERRORS AND/OR OMISSIONS.
YOU EXPRESSLY AGREE THAT USE OF THIS SERVICE, INCLUDING ALL
CONTENT, DATA OR SOFTWARE DISTRIBUTED BY, DOWNLOADED OR
ACCESSED FROM OR THROUGH THIS SITE, IS AT YOUR SOLE RISK.
YOU UNDERSTAND AND AGREE THAT YOU WILL BE SOLELY RESPONSIBLE
FOR ANY DAMAGE TO YOUR BUSINESS, YOUR COMPUTER SYSTEM OR
LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH CONTENT,
DATA AND/OR SOFTWARE.
YOU ACKNOWLEDGE THAT DILSEBOL DOES NOT CONTROL IN ANY
RESPECT ANY INFORMATION, PRODUCTS, OR SERVICES OFFERED BY
THIRD PARTIES ON OR THROUGH THIS SERVICE. EXCEPT AS
OTHERWISE AGREED IN WRITING, DILSEBOL AND ITS AFFILIATES
ASSUME NO RESPONSIBILITY FOR AND MAKE NO WARRANTY OR
REPRESENTATION AS TO THE ACCURACY, CURRENCY, COMPLETENESS,
RELIABILITY OR USEFULNESS OF CONTENT OR PRODUCTS DISTRIBUTED
OR MADE AVAILABLE BY THIRD PARTIES THROUGH THIS SITE.
YOU ACKNOWLEDGE THAT DILSEBOL MAKES NO WARRANTY OR
REPRESENTATION THAT CONFIDENTIALITY OF INFORMATION
TRANSMITTED THROUGH THIS SITE WILL BE MAINTAINED.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED
BY YOU FROM DILSEBOL OR THROUGH OR FROM THE SITE SHALL
CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE AGREEMENT.
16. LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO
CIRCUMSTANCES INCLUDING, WITHOUT LIMITATION, ITS OWN
NEGLIGENCE, SHALL DILSEBOL OR ITS PARENTS, SUBSIDIARIES,
OFFICERS, EMPLOYEES, AFFILIATES, DIRECTORS, AGENTS,
SUPPLIERS, OR ANY OTHER PARTY INVOLVED IN CREATING,
PRODUCING, TRANSMITTING, OR DISTRIBUTING DILSEBOL OR RELATED
SERVICES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT
NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE,
DATA OR OTHER INTANGIBLE LOSSES (EVEN IF DILSEBOL HAS BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
(A) THE USE OR INABILITY TO USE THE SITE; (B) THE COST OF
PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM
ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR
OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO
THROUGH OR FROM THE SITE; (C) UNAUTHORIZED ACCESS TO OR
ALTERATION OF YOUR TRANSMISSIONS OR DATA; (D) STATEMENTS OR
CONDUCT OF ANY THIRD PARTY ON THE SITE OR (E) ANY OTHER
MATTER RELATING TO THE SITE. IF SOME JURISDICTIONS DO NOT
ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN LIABILITIES, IN
SUCH CASES LIABILITY IS LIMITED TO THE FULLEST EXTENT
PERMITTED BY LAW.
17. SEVERABILITY
If any provision of this Agreement is invalid, illegal or
unenforceable under any applicable statute or rule of law,
such provision shall be deemed amended to achieve as nearly
as possible the same economic effect as the original
provision and the remaining provisions of this Agreement
shall in no way be affected or impaired.
18. Returns
The Dilsebol Promise: If you are not 100% satisfied with the
quality, please let us know within 30 days the nature of the
problem and we will make a free replacement for all valid
quality problems. Quality problems due to rough and
non-intended use of the product are excluded from this
promise.
Also, Dilsebol holds no imprinted inventory and we do not
re-stock product. We produce each and every customer order
on a personalized basis which allows us to customize the
product. For this reason Dilsebol is unable to accept
returns or exchanges of product due to your desire to the
change the size, style, colour, art or design of the product
that has been already ordered.
Dilsebol's responsibility is to duplicate, to the best of
our ability, art and designs which are submitted even though
the art may be low resolution or may be defective in some
way. Dilsebol will imprint art exactly as it is received
from the customer and, does not accept written requests to
alter the art/design which is submitted with the order.
Dilsebol is not responsible for and does not accept returns
or exchanges due to the arts' ""look"" or ""feel"". The
actual product may be different from what appears on the
computer screen. The ""look"" or ""feel"" of the arts
application to the product and / or it being different from
the appearance on the computer screen is not grounds for the
return of the product as long as the design is fully applied
to the product.
19. Shipping
All processed orders will be shipped by Dilsebol through our
designated shipping carrier / courier agency.
Title and risk of loss for all Products ordered by you shall
pass to you on Dilsebol's shipment to the shipping carrier /
courier agency.
Dilsebol aims to ship your orders in less than 3 days!
(Remember, these are made-to-order custom products!).
Usually, for most places in India, our shipping partners
will deliver it within 1 day, so your total time to receive
your made-to-order custom products is less than 4 days.
However, shipping time for some parts of India is greater
than 1 day. For information on shipping time click here. We
regret we cannot ship Dilsebol products outside of India.
20. Cancellation
Due to the customized nature of all products sold on our
Site, cancellations will not be honoured once an order has
entered production. All orders are to be fully paid for at
the time of production.
21. Reward Points
Dilsebol offers reward points on purchase of certain
products as per the Rewards points policy framed by the
company from time to time. These reward points can be
redeemed for products offered at www.dilsebol.com only. The
reward points cannot be redeemed for cash.
